Start of the K-15 payment: Who has the right and how much will they get?

Private sector companies now have the ability to process the repayment of annual overtime compensation, designated as K-15. This legal obligation to repay overtime payments remains in effect until December 31st of the current year. The specific amount of the K-15 repayment is not standardized; rather, it varies based on the timing of the employee’s request to receive the overtime pay back.

The general guidelines stipulate that an employee can claim a minimum of 100% and a maximum of 40% of the overtime pay applicable in the relevant jurisdiction. However, the law outlines specific exceptions to these general rules. Regarding the repayment claims, the private sector employer is permitted to claim a maximum of 19,116 units to facilitate the payback of K-15.

In contrast, the employee has a higher maximum claim limit, set at 47,790 units. The final calculated amount for both the employer and the employee will be adjusted according to the established basis for calculation. This framework provides a structured process for companies to manage and repay accumulated overtime compensation.
