Judicial Board Confirms State’s Role in Regulating Online Games

In a presentation regarding the legal justification for the law on gambling and amusement games, Prof. Dr. Aleksandar Klimovski, Director of the State Lottery, argued for the state’s exclusive regulatory authority over internet gambling.

This position was supported by a recent decision, U. br. 156/2019, issued on May 6th, 2020, by the Judicial Board.

The decision clarifies that the legal basis for the new justification – the state’s right to regulate – does not involve a review of the constitutionality of Articles 2 and 3 of the Law on gambling and amusement games. Consequently, the state is not presenting a misleading constitutional argument. The Judicial Board’s assessment centers on the principle of separation of powers within the regulation of gambling.

They determined that the legislator’s decision to retain state oversight stems from this established legal framework. Specifically, the board emphasized that the state’s role in regulating online games is grounded in maintaining a balanced system of governance. The ruling underscores the judicial body’s confirmation of the state’s continued authority in this sector.
