The administration of U.S. President Donald Trump has initiated a series of investigations targeting key economic partners to establish a new legal basis for imposing tariffs. This follows the Supreme Court’s prior ruling that Trump’s invocation of an economic emergency was unlawful.
Investigations will encompass the European Union, Switzerland, Norway, China, Japan, Mexico, Taiwan, India, and other Asian nations, excluding Canada. U.S. Trade Commissioner, Jaymeison Greer, stated the investigation relates to specific provisions of the 1974 Trade Act, citing suspicions of excessive production capacity in several countries, potentially harming U.S.
markets. The investigation also includes concerns about the exploitation of child and slave labor, spanning over 60 countries. The U.S.
identifies nations with surpluses in sectors like aluminum, batteries, electronics, machinery, semiconductors, vessels, solar cells, and steel as particularly vulnerable to the impact of American manufacturing. Public hearings are scheduled to begin in May, and consultations will be held with the governments of affected countries. These investigations represent a first step in Trump’s effort to reinstate high tariffs on numerous nations.
The Supreme Court invalidated Trump’s initial tariffs in February, citing overreach of presidential authority. Trump subsequently implemented additional tariffs of 10% and then 15% without congressional approval. The investigation relies on Section 122 of the 1974 Trade Act, allowing for tariffs up to 150 days without congressional approval, expiring on July 24th, requiring congressional consent for continued higher tariffs.
